1. Overview
This Marketing Communications Policy describes how Myro Health (“Myro,” “we,” “us,” or “our”) sends promotional and marketing communications to users of our Services. This policy supplements our Privacy Policy and Terms & Conditions.
Marketing communications are entirely separate from service-related communications. Your consent to receive marketing communications is optional and is not a condition for using Myro Health services.
2. What Are Marketing Communications
Marketing communications include, but are not limited to:
- Health tips, wellness articles, and educational content.
- Product updates, new features, and service announcements.
- Promotional offers, discounts, and referral program updates.
- Seasonal health campaigns (e.g., monsoon health tips, summer wellness guides).
- Partner offers and collaborations (e.g., wellness brands, fitness services).
- Newsletters and periodic health digests.
- Surveys and feedback requests about new features or services.
3. What Are Not Marketing Communications
The following are service-related communications that are essential to delivering your Myro Health experience. These are sent regardless of your marketing preferences:
- Lab test result notifications.
- Appointment reminders (doctor, nutritionist, sample collection).
- Health alerts and critical biomarker notifications.
- Daily health task reminders and nudges.
- Subscription status updates (renewal, expiry, payment confirmations).
- Account security notifications (OTP, login alerts, password changes).
- Responses to your support requests or grievances.
- Updates to our Terms & Conditions or Privacy Policy.
4. Your Consent
4.1 How We Obtain Consent
During onboarding, you will be presented with a separate, clearly labeled consent toggle for marketing communications. This toggle is set to OFF by default. You must actively opt in to receive marketing communications.
Your marketing consent is independent of your consent for health data processing and your agreement to our Terms & Conditions. Choosing not to receive marketing communications will have no impact on your access to or experience of Myro Health services.
4.2 Channels
If you opt in, we may send marketing communications through the following channels:
- Push Notifications: Through the Myro Health mobile app.
- Email: To the email address registered with your account.
- SMS: To the phone number registered with your account.
- In-App Messages: Banners, cards, or messages within the Myro app.
- WhatsApp: To the phone number registered with your account, if you have opted in specifically for WhatsApp communications.
4.3 Frequency
We respect your time and attention. Our typical communication frequency is:
- Email: No more than 2 emails per week.
- Push Notifications: No more than 3 promotional notifications per week.
- SMS: No more than 2 promotional messages per month.
- WhatsApp: No more than 2 promotional messages per month.
We reserve the right to send additional communications during major health campaigns or product launches, but will always stay within reasonable limits.
5. Opting Out
You can opt out of marketing communications at any time through any of the following methods:
5.1 In-App
Go to Settings > Privacy > Marketing Communications and toggle off your preferences. You can opt out of all marketing communications at once or selectively disable specific channels (email, push, SMS, WhatsApp).
5.2 Email
Click the “Unsubscribe” link at the bottom of any marketing email. This will remove you from our marketing email list within 48 hours.
5.3 SMS
Reply “STOP” to any marketing SMS to opt out of SMS-based marketing communications.
5.4 Contact Us
Email marketing@myrohealth.com with the subject line “Unsubscribe” to opt out of all marketing communications.
Opting out of marketing communications will not affect your receipt of service-related communications as described in Section 3.
6. Data Usage for Marketing
If you opt in to marketing communications, we may use the following data to personalize your marketing experience:
- Your name and basic profile information for personalized greetings.
- Your subscription plan type to send relevant offers.
- Your general health interests (e.g., if you track fitness metrics, you may receive fitness-related tips).
- Your app usage patterns to determine optimal communication timing.
We will never:
- Share your identifiable personal data with third-party advertisers.
- Use your specific lab results or health conditions for targeted advertising.
- Sell your contact information to any third party for marketing purposes.
- Send you marketing for pharmaceutical products based on your health data.
7. Third-Party Marketing
We do not share your personal data with third parties for their direct marketing purposes. If we feature partner offers (e.g., wellness brands, fitness services) in our communications, these are curated and sent by Myro Health, not by the third party. The third party will not receive your personal data unless you choose to engage with their offer independently.
8. Regulatory Compliance
Our marketing communications comply with:
- DPDP Act, 2023: Marketing consent is obtained separately from service consent, in accordance with Section 6 of the Act. Consent is free, specific, informed, and unambiguous.
- TRAI Regulations: Commercial SMS and calls comply with the Telecom Regulatory Authority of India (TRAI) regulations on unsolicited commercial communications.
- IT Act, 2000: Electronic communications comply with the Information Technology Act, 2000.
9. Updates to This Policy
We may update this policy from time to time. Material changes will be communicated through the app or email. The updated version will be indicated by the “Last updated” date at the top of this document.
